TERMS AND CONDITIONS

 

Thank you for patronizing Foster's Auction House/FAH!

We appreciate your business! Foster's Auction House is owned by

Auctioneer- Clellan Foster TX State License 17428.

-ALL INVOICES must be paid in full and directly to the auction house on the night of the auction. Winning online bidders must pay all invoices directly to FAH in full no later than 5pm the following day. All items MUST be paid for prior to removal from our building. Please check over your invoice carefully! Any discrepancies must be addressed with FAH within 24 hours of the end of the auction or the invoice stands as is. *FAH has a 13% Buyer's Premium with a 3% DISCOUNT for payments made by CASH or CHECK. We accept Check, Cash, Credit/Debit (VISA, MASTERCARD, DISCOVER). In order to use a CC or DC, you must make a purchase of at least $25.00.

-All items sold are AS IS/WHERE IS except when a guarantee is specified by the auctioneer. No FAH staff member has the authority to make statement of guarantee or warranty. All property is open to public inspection during preview periods prior to the beginning of the auction. Statements, pictures, and descriptions are opinions only and are not representations or warranties. A bid by any person shall be considered conclusive proof of acceptance of condition of sale herein stated.

-The buyer is the highest bidder acknowledged by the auctioneer for each lot. Once the auctioneer says "sold", the bidder has become a winning bidder and has effected a legal contract of sale. Upon the word "sold", the responsibility for items immediately passes from the auction to the buyer. TIE BIDS

- The auctioneer has the discretion to re-open the bid or sale to the highest bidder acknowledged.

-Any FAH staff member, including the owners and the auctioneer, reserve the right to bid on any item in the auction so long as the paid amount is the same as any other bidder would pay without discount or advantage.

-CONSIGNORS may not bid on their own merchandise AT ANY TIME.

-All reasonably sized items must be taken home the night of the auction. Please see one of our FAH staff members to arrange PICK UP of any item (furniture, large signs, etc.) that cannot be taken home the night of the auction. ALL items that require an arrangement of pick up must be removed within a 7 day period. Under special circumstances, FAH will offer a 2-3 day extension.

-SHIPPING If your purchases require shipping you are responsible for making all arrangements for packing, shipping as well as all cost for those services. We are happy to assit with shipping when possible.

***AUCTIONEER, AUCTION COMPANY, and AUCTION STAFF MEMBERS SHALL NOT BE HELD LIABLE FOR ANY PERSONAL INJURY OR LOSS ON THE PROPERTY. BY RECEIVING THE BID CARD YOU RELEASE FOSTER'S AUCTION HOUSE, IT'S OWNERS, AND STAFF MEMBERS FROM ALL RESPONSIBILITY AND LIABILITY.

HiBid is the Internet Absentee Bidding platform for our live auctions. Please do not Internet bid if you are attending the live auction. The online bids will be downloaded and brought to compete against a live bidding crowd on the day of the live auction. If you are winning an item at the close of online bidding, you have not purchased it yet, the item will run through live auction where the live audience will also have the opportunity to bid. If you are out bid at the live auction you will NOT have won the item.  

If you are the winning bidder, you will be notified by email or phone the following Sunday, payment is due then.  

Shipping is available to approved buyers. Please make arrangements for shipping with us prior to bidding  Please contact the UPS Store to discuss the items you are interested in buying and they can provide you with a quote to ship.  

Packaging and shipping charges will be applied and are the responsibility of the buyer. Oversized items will require custom crates and freight shipping. 

FAH is not responsible for shipping claims, damages or items lost by shipping companies. Once the tracking number is issued any disputes are between the buyer and the shipper.

Items not picked up by the following Wednesday evening will be sold in the next auction with no refund. 

All items are sold as is/where is, no warranty, no gaurantee.
